EquipAssist Borrowing Terms

1. Scope and Agreement
These Borrowing Terms apply whenever an EquipAssist user lists, requests, lends, borrows, picks up, uses, or returns equipment through the Service. They supplement the EquipAssist Terms of Service and Privacy Policy.
By submitting or accepting a borrow request, both the equipment owner (“Owner”) and borrower (“Borrower”) agree to these Borrowing Terms and to the transaction details recorded between them.
EquipAssist is operated by Earl Clark, operating as EquipAssist, in North Carolina, USA.
2. EquipAssist’s Role
EquipAssist provides technology that helps users discover listings, communicate, and coordinate peer-to-peer transactions. EquipAssist is not the owner, seller, lessor, custodian, inspector, certifier, manufacturer, healthcare provider, insurer, or guarantor of user-listed equipment and is not a party to the agreement between an Owner and Borrower.
Unless EquipAssist expressly agrees otherwise in writing, EquipAssist does not:
- Inspect, clean, test, repair, approve, certify, deliver, or store equipment
- Confirm ownership, prescriptions, training, licensing, or medical suitability
- Provide insurance or guarantee payment, return, condition, safety, or performance
- Hold funds in escrow, collect debts, or issue binding damage awards
- Provide medical advice, monitoring, treatment, or emergency assistance
3. Owner Responsibilities
Before transferring equipment, the Owner must:
- Have the legal right to possess and lend the equipment
- Confirm that lending the equipment is lawful and not prohibited by a prescription, recall, manufacturer restriction, insurance condition, or applicable rule
- Accurately describe the item, included accessories, known defects, maintenance history, cleanliness, availability, and condition
- Disclose known recalls, modifications, damage, contamination, missing parts, and safety concerns
- Provide available manufacturer instructions and warnings
- Clean or sanitize the equipment as appropriate for the item and disclose the cleaning method
- Remove personal information left on connected or electronic equipment
- Use photos or written records to document condition at handoff
An Owner must not list equipment that is stolen, counterfeit, recalled, contaminated, unsafe, unlawfully obtained, or legally restricted from peer-to-peer transfer.
4. Borrower Responsibilities
Before accepting or using equipment, the Borrower must:
- Inspect the equipment and confirm that its identity, condition, parts, and accessories match the listing and agreement
- Determine, with a qualified healthcare professional when appropriate, whether the equipment is suitable for the intended user
- Read and follow manufacturer instructions, warnings, weight limits, maintenance guidance, and applicable prescriptions
- Confirm they have any training, assistance, supplies, power source, or supervision needed for safe use
- Promptly report an apparent defect, recall, contamination, malfunction, damage, or missing component and stop use when continued use may be unsafe
- Keep the equipment secure and use it only for the agreed lawful purpose
- Not modify, repair, sublet, resell, pledge, or transfer the equipment without the Owner’s written permission
If there is an emergency or suspected injury, stop using the equipment when safe to do so and contact 911, the appropriate emergency service, the manufacturer, or a qualified healthcare professional. EquipAssist support is not an emergency service.
5. Transaction Details and Handoff
The parties should record important terms in EquipAssist messages before handoff, including:
- The exact equipment and accessories included
- Pickup and return date, time, and location
- Condition at handoff, supported by photos when appropriate
- Cleaning, charging, consumable, transportation, and setup responsibilities
- Any agreed late-return, loss, or damage terms permitted by law
- A safe method for contacting each other
Meet in a location appropriate to the item and circumstances. Do not publish an exact home address or sensitive medical information in a public listing.
Either party may decline a transaction before handoff. After handoff, cancellation, early return, extension, or changed terms require agreement between the parties unless law requires otherwise.
6. Use, Care, and Return
The Borrower must exercise reasonable care and return the equipment by the agreed time in substantially the condition received, ordinary wear from agreed use excepted.
Unless the parties agree otherwise, the Borrower is responsible for:
- Keeping all components and accessories together
- Protecting the item from theft, weather, contamination, misuse, and unauthorized users
- Using only compatible power supplies, batteries, accessories, and consumables
- Returning the item clean and free of personal information
- Promptly notifying the Owner of delay, loss, damage, malfunction, or safety concern
The parties should document condition again at return and retain relevant messages and photos until any issue is resolved.
7. Medical Safety
Equipment available through EquipAssist may affect health or mobility. A listing or another user’s statement is not medical advice or a guarantee that an item is safe, sterile, calibrated, complete, or appropriate.
Owners and Borrowers are each responsible for complying with laws and safety requirements applicable to them. Some equipment may require a prescription, licensed provider, professional setup, calibration, ongoing maintenance, infection-control procedure, or may not lawfully be transferred between individuals. If unsure, do not proceed until you obtain qualified advice.
Do not use EquipAssist to obtain or transfer medication, controlled substances, implanted devices, biological materials, or equipment whose transfer is prohibited.
8. Loss, Damage, and Costs
Responsibility for loss, damage, cleaning, consumables, transportation, or late return is a matter between the Owner and Borrower, subject to their written agreement and applicable law.
An Owner making a claim should provide the Borrower with reasonable documentation of the item’s prior condition, the claimed damage or loss, and the requested amount. A Borrower should promptly provide relevant condition records and a written response.
EquipAssist may review platform records, accept reports, preserve evidence, restrict an account, or help the parties communicate. EquipAssist does not guarantee recovery, decide legal liability, collect payment, or replace a court, insurer, law-enforcement agency, manufacturer, or professional evaluator.
9. Reports and Disputes
The parties should first attempt to resolve a non-emergency issue through EquipAssist messaging. Keep communication factual and do not threaten, harass, or publicly disclose another user’s private information.
To report a safety issue, suspected fraud, prohibited item, harassment, or unresolved transaction problem, use in-app Help & Support or email support@equipassist.net. Include the relevant request or listing information and only the evidence needed for review.
EquipAssist may take platform actions such as warning a user, removing content, limiting features, suspending an account, or preserving records. Platform action is separate from a legal determination between the parties. Users may pursue available legal remedies, insurance claims, manufacturer remedies, or reports to appropriate authorities.
10. Privacy
Information shared for a transaction may be used only to coordinate and complete that transaction, address safety, resolve a dispute, or comply with law. Users may not use another person’s contact, location, health, or transaction information for advertising, harassment, surveillance, or unrelated purposes.
Condition photos, messages, reports, and transaction records may be processed by EquipAssist as described in the Privacy Policy.
11. Assumption of Risk
Peer-to-peer equipment transactions involve risks, including misdescription, improper fit, contamination, malfunction, delayed return, property damage, bodily injury, and interaction with strangers. To the fullest extent permitted by law, Owners and Borrowers knowingly accept the risks arising from their own decisions, equipment, conduct, and direct agreements.
Nothing in these Borrowing Terms excludes rights or liability that cannot lawfully be excluded.
12. Changes to These Terms
We may update these Borrowing Terms as the Service or applicable law changes. We will update the date above and provide additional notice when required. The version accepted for a transaction will govern that transaction unless a change is required by law or the parties agree otherwise.
